Rubbish Clearance Watford Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Watford provides waste removal, rubbish clearance and related collection services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions.

If you do not accept these Terms and Conditions, you must not proceed with any booking or use our rubbish clearance services.

Definitions

In these Terms and Conditions, the following words have the meanings given:

Company, we, us, our means Rubbish Clearance Watford, the service provider.

Customer, you, your means the person, business or organisation requesting and paying for our waste collection or clearance services.

Services means rubbish clearance, waste collection, bulky waste removal, recycling, loading, transport and disposal or any related work we agree to carry out.

Booking means a confirmed request for Services, whether made by telephone, email, online form or in person.

Waste means the materials, items or rubbish you ask us to remove during the provision of our Services.

Scope of Services

We provide a range of waste collection and rubbish clearance services, including but not limited to household rubbish removal, garden waste clearance, office and commercial waste collection, bulky waste and general non-hazardous waste disposal.

The exact scope of the Services will be specified at the time of booking and confirmed in our quotation or booking confirmation. We reserve the right to refuse any item or waste type that we reasonably believe to be hazardous, illegal, improperly described or unsuitable for our vehicles or facilities.

Booking Process

You may request a quotation or make a booking by contacting us via telephone or email, or by using any other communication method we accept from time to time. In order to provide an accurate quotation and schedule the collection, you will need to provide full and accurate details of:

The type and approximate volume or weight of waste to be collected.

The collection address and any access restrictions or parking limitations.

The preferred date and time window for the rubbish clearance.

The presence of any unusual, heavy, restricted or potentially hazardous items.

Where possible, we may ask for photographs or additional information so that we can estimate the load size and resources required. Any quotation given prior to viewing the waste is an estimate only and may be adjusted on site if the volume, weight, access or nature of the waste differs from the description given at the time of booking.

A booking is only confirmed when we have agreed the date, approximate arrival time and price estimate with you, and you have accepted these Terms and Conditions. We reserve the right to reschedule or decline a booking where we reasonably consider it impractical, unsafe or outside our normal service area or capacity.

Access and Parking

You are responsible for ensuring that our vehicles and staff have safe and reasonable access to the collection point. This includes arranging adequate parking, informing us of any restrictions such as controlled parking zones, permits, time limits or height and weight limits, and providing correct instructions for entry to the property or site.

If parking charges apply, these may be added to the final invoice, along with any penalty charges we incur as a direct result of incorrect information or lack of required permissions provided by you. If we are unable to access the premises or safely load waste due to access or parking issues, this may be treated as a failed collection and subject to our cancellation or call-out charges.

Customer Responsibilities

You must ensure that:

All waste for collection is properly identified, clearly separated from items not to be removed, and is reasonably accessible to our team.

No prohibited, hazardous or special waste is included unless we have expressly agreed in advance and you have provided all relevant information and documentation.

There is an authorised adult present at the property to grant access, provide instructions and confirm the items to be removed, unless we have agreed otherwise in writing.

You have the authority of the property owner or occupier to authorise our rubbish clearance work on the premises.

Any fragile, valuable or personal items that are not to be removed are stored safely and clearly away from the waste to avoid accidental inclusion in the collection.

If our team is required to enter buildings, gardens or other areas of your property, you must ensure they are reasonably safe and free from unnecessary hazards.

Waste Types and Prohibited Items

Our standard rubbish clearance and waste collection services are intended for general non-hazardous waste. Certain items are restricted or prohibited by law or by our internal safety policies. Without prior specific agreement, we do not collect:

Asbestos or materials containing asbestos.

Clinical or medical waste, including sharps.

Chemicals, solvents, oils, paints, fuels or other liquid hazardous substances.

Gas bottles, pressurised containers or explosive materials.

Large quantities of tyres or specialist industrial waste.

Electrical or electronic equipment that requires specific licensed treatment, unless explicitly agreed as part of the booking.

Any other waste which is classified as hazardous or controlled in a way that requires special handling, licences or permits that we do not hold for the specific collection.

If prohibited or misdescribed items are found in your waste at the time of collection, we may refuse to remove them, apply additional reasonable charges for handling, or cancel the job if we consider there to be a safety or legal risk.

Pricing, Quotations and Estimates

All prices are quoted in pounds sterling unless stated otherwise and may be subject to applicable taxes. Our quotations are based on information provided by you and on standard assumptions about access, loading time and waste type.

Where we provide an estimate without inspecting the site or waste in person, this estimate is indicative only. The final price may be adjusted on arrival based on the actual volume, weight, loading time, site conditions and waste classification. If the price needs to be varied, we will explain the reasons and seek your agreement before proceeding.

We may charge extra for:

Additional labour where significant dismantling, sorting, or difficult access is involved.

Extended loading times beyond what was reasonably expected.

Special disposal fees or third-party charges for particular waste types.

Parking fees, congestion or low emission zone charges, and any fines incurred directly due to incorrect or incomplete information supplied by you.

If you do not accept any revised price on site, we reserve the right not to proceed with the collection, in which case a call-out or cancellation fee may apply.

Payments and Invoicing

Payment terms will be agreed at the time of booking. Unless otherwise agreed, payment is due upon completion of the rubbish clearance service, and must be made by an accepted payment method such as cash, card, or bank transfer.

For commercial or repeat customers, we may agree credit terms or issue invoices payable within a specified period. Late payment may result in additional charges, interest and suspension of further collections until the account is settled.

We retain ownership of any collected materials only after full payment has been received, subject to any mandatory transfer obligations under waste regulations.

Cancellations and Rescheduling

You may cancel or reschedule a booking by contacting us within our stated office hours. We ask for as much notice as possible so we can manage our schedule efficiently.

We reserve the right to charge a cancellation fee where:

You cancel with less than 24 hours notice before the agreed arrival window.

Our team attends the site at the agreed time but is unable to gain access or proceed due to circumstances within your control.

You refuse to proceed after our team has arrived and assessed the job, unless the refusal is due to a significant and unreasonable price increase that you were not informed about in advance.

If we need to cancel or reschedule a booking due to vehicle breakdown, staff illness, severe weather, traffic disruption or other unforeseen circumstances, we will inform you as soon as reasonably possible and offer an alternative date and time. We will not be liable for any indirect or consequential losses arising from such rescheduling, but any prepayments for unperformed services will be refunded.

Provision of Services and Time Windows

We aim to attend your property within the agreed arrival window, but collection times are approximate and subject to traffic and operational factors. Time is not of the essence in relation to our performance of the rubbish clearance service.

We will carry out the Services with reasonable skill, care and diligence, and in a manner consistent with professional rubbish clearance and waste collection practice. You must promptly inform our team of any concerns or specific instructions at the start of the job.

Waste Handling, Transfer and Disposal

We are committed to responsible waste management. We will transport the collected waste to appropriate facilities for disposal, recycling or recovery, in compliance with applicable waste regulations. Where required, we or our authorised partners will complete and retain relevant documentation for waste transfer and disposal.

Once waste is collected and loaded into our vehicle, it becomes our responsibility, and we will endeavour to ensure that it is handled and treated lawfully. However, you are responsible for accurately describing the waste and for any consequences arising from undisclosed hazardous or miscategorised materials.

Compliance with Waste Regulations

We operate in accordance with relevant UK waste legislation and environmental regulations. As a customer, you also have legal duties to ensure that your waste is transferred only to an authorised person and that it is correctly described.

By using our rubbish clearance services, you confirm that you have the right to dispose of the waste and that it does not include items that we are not legally permitted to carry or that require specific licences we do not hold. We reserve the right to refuse any waste if we believe its collection or transportation would breach legal or regulatory requirements.

Liability and Limitations

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

Subject to the above, our total liability to you in respect of any loss or damage arising from or in connection with our Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific rubbish clearance job in relation to which the claim arises.

We are not liable for:

Any indirect, consequential, special or economic loss, including loss of profits, loss of business or loss of opportunity.

Damage to items or fixtures that are not clearly separated from the waste or that are fragile and left in or near the rubbish to be removed.

Loss or damage resulting from inaccurate information provided by you, unsafe site conditions, or your failure to comply with these Terms and Conditions.

Minor cosmetic damage unavoidably caused during the normal loading and removal of bulky waste items, provided our team has acted with reasonable care.

You must notify us in writing of any alleged loss or damage as soon as reasonably practicable and in any event within 7 days of completion of the Services. We may need access to inspect any alleged damage before any repairs or alterations are carried out.

Indemnity

You agree to indemnify us and hold us harmless from and against any claims, losses, damages, costs and expenses arising out of:

Your breach of these Terms and Conditions.

Your failure to disclose relevant information about the waste or site conditions.

The inclusion of prohibited, hazardous or illegal items in the waste presented for collection.

Events Beyond Our Control

We shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include severe weather, accidents, road closures, strikes, breakdowns, public emergencies or other unforeseen events. In such circumstances we will take reasonable steps to notify you and to resume services as soon as reasonably practicable.

Data Protection and Privacy

We collect and process personal information only to the extent necessary to manage bookings, provide rubbish clearance services, issue invoices, and communicate with you about your waste collection. We will handle your personal data in accordance with applicable data protection laws and use appropriate measures to keep it secure.

Your details will not be sold to third parties. We may share necessary information with our staff, contractors or service partners solely for the purpose of providing and administering the waste removal services.

Amendments to Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, services, or applicable laws and regulations. Any such changes will take effect when published or when notified to you. The terms that apply to a particular booking will be those in force on the date you make or confirm that booking.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remaining terms, which shall continue in full force and effect.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of our rubbish clearance and waste collection services and supersede all previous agreements, understandings or arrangements, whether written or oral, relating to the same subject matter.

By proceeding with a booking or allowing our team to commence work, you confirm that you have read, understood and agree to these Terms and Conditions.
